WHAT IS YOUR RETURN POLICY?
We want you to be completely happy with your johnnie-O purchase - especially during the holiday season. Orders placed between 11/1/25 and 12/24/25 can be returned through 1/31/26, or 60 days, whichever is later. All goods marked as ‘Final Sale’ cannot be exchanged or returned. Please note that any original shipping charges are not eligible for refund. Johnnie-O will not accept any merchandise from third party retailers (unless purchased at a Johnnie-O Retail store or Meta Shops). Please allow 1-2 weeks for a refund of your purchase. Johnnie-O does not accept returns on international orders.
Can I return/exchange online purchases in store?
Yes! Online purchases can be returned or exchanged at any of our Johnnie-O Retail store locations. For more information on our store locations, please visit our Stores page.
DO YOU OFFER EXCHANGES?
Johnnie-O allows free shipping on exchanges for the same item in a different color and/or size. Exchange orders are created in our system when your return package is in transit. Inventory is not held for your exchanges and can go out of stock before the exchange order is created, so we recommend returning the original order as quickly as possible. For immediate exchanges, please enter your card details during the exchange request. You will only be charged if your returned items are not in the mail within 60 days.
DO YOU OFFER PRICE ADJUSTMENTS?
We honor a one-time price adjustment within one week of the purchase date
Promotions, flash-sales, friends & family, and end of season sale will be excluded from price adjustments.
WHAT SHIPPING OPTIONS DO YOU OFFER?
We offer free ground shipping on exchange orders. If you require expedited shipping, we recommend returning your item(s) for a refund and placing a new order online with expedited shipping.
HOW DO I EXCHANGE A GIFT?
You will be asked to verify the order number (in the enclosed packaging) and delivery address zip code. If the gift was not mailed directly to you, please reach out to our customer service team, wingman@Johnnie-O.com so we can help locate the order and process the gift return.
You will receive store credit when you return a gift, which can be used to place a new order on our site. The gift giver does not receive any notifications around this process.
CAN GIFT CARDS BE RETURNED?
Gift Cards cannot be returned, refunded, exchanged, or redeemed for cash.
CAN I RETURN AN ITEM THAT WAS A GIFT WITH PURCHASE?
Gifts with Purchase cannot be returned, refunded, exchanged or redeemed for cash.
CAN I RETURN AN ITEM THAT WAS PURCHASED FROM AN AUTHORIZED RETAILER?
We don’t accept returns of Johnnie-O items purchased from third-party retailers (Nordstrom, Golf Pro Shops, Johnnie-O Signature Stores, etc.). Please contact the third-party retailer where you made your purchase directly for information on their return policy.
WILL I BE CHARGED SHIPPING FOR RETURNS?
Returns in our stores and at a Happy Returns Return Bar are free! We've partnered with Happy Returns for an easy box-free, printer-free return or exchange. Our returns portal will show you the closest Returns Bars and Johnnie-O Retail Stores to you, if applicable.
We offer free "mail-in" returns on your first purchase and all exchange orders.
If you are returning for a refund, a flat fee of $7 per return label used will be deducted from your refund to cover the cost of return shipping. Note that this fee is not per item and only one $7 charge will be made per return order. If multiple returns are generated on the same order, the return fee will be applied to each return order. This fee only applies to "mail-in" returns — returns in our stores and at a Return Bar are free.
Returns that haven't been dropped off at a Johnnie-O Retail Store, Happy Returns Return Bar or shipped within 30 days will automatically expire.
WHAT IS A RETURN BAR?
We partner with Happy Returns to offer free, easy, and environmentally friendly returns at nearly 8,000 locations in the contiguous U.S. No shipping box or label required!
Simply select Happy Returns as your return method in our online returns portal and bring your unworn/unwashed items with tags attached to a Return Bar near you. Once your emailed QR code is scanned at a Happy Returns Return Bar, your return or exchange will begin processing. To find the closest Happy Returns location, click HERE
HOW LONG TO RETURNS TAKE TO PROCESS?
Please allow 1-2 weeks for returns to be processed.
Will the price at the time of sale be the price that is refunded or credited?
Keep in mind all applicable promotions, discounts, offers, and free items (as part of a qualifying purchase) granted at the time of purchase will be prorated and applied to the amount of refund or credit.
If an item arrives damaged or is incorrect, what should I do?

CAN I CHANGE SOMETHING ON MY ORDER?

HOW LONG DOES IT USUALLY TAKE TO GET A PACKAGE?
We strive to process orders as quickly as we possibly can. Orders placed Monday through Friday are usually shipped within 24-48 hours. If you’re located in the Midwest or on the East Coast, packages usually arrive within 2-3 business days. Awesome, we know. West Coast takes a bit longer, but should be at your door within 3-5 business days. Please note that orders including NCAA, MLB, U.S. Open, or other custom embroidery products will require 7-10 business days for custom embroidery before shipping your entire order.

WHEN WILL MY CUSTOM EMBROIDERED MLB, NCAA, U.S. Open, OR OTHER EMBROIDERED PRODUCT ARRIVE?
Please allow 7-10 business days for custom embroidery before shipping your full order. In an effort to reduce packaging waste and CO2 emissions, non-embroidery and embroidered items ship together.
WHY DOES THE NCAA COLLECTION INCLUDE ALL SCHOOLS?
We do not have the licensing to create gear for all schools. However, we hope to add new schools throughout the next year so please be sure to check back on our website for when new schools are added.

HOW DO I UNSUBSCRIBE FROM YOUR EMAIL LIST?
You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of registration. If you wish to update, delete or modify your personal data, please make changes to "Account Details" online by clicking "Sign In" or “Hi, NAME” if you’re already signed in. Be sure to "Save" once you've completed your changes or they may not take effect. You may also call or email Customer Service. You may need to provide your exact name and postal or email address so that we may identify you accurately. You may also "unsubscribe" from our email by using the link provided at the bottom of each email. If you ask us to remove you from marketing lists, we will maintain you on a "do not contact" list to ensure that we continue to honor your request. In most cases it takes ten (10) days or less to process your "do not email" request. It may take up to eight (8) weeks to process your "do not mail" request because mailings are planned long in advance. If you purchase online, we will continue to confirm your order and shipment status via email, postal address or telephone. If you change your mind about choices you've previously made, make changes to "My Account" online or contact Customer Service. We will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable (but we may retain prior information as business records). Please note that it is not always possible to completely remove or delete all of your information from our databases and that residual data may remain on backup media or for other reasons.
ARE YOU SHIPPING TO MY COUNTRY?
Our mantra is to provide as many people as possible access to our products. You will find a list of countries we ship to at checkout.
HOW MUCH DO I PAY FOR SHIPPING?
The cost for shipping your order depends on your address, and the service level you choose for shipping (Express, Standard). Our commitment to you is that we are 100% transparent with the shipping cost. We keep the shipping cost as low as possible and through our logistics partner select the best and most reliable carriers available to ensure your order arrives on time.
WHAT ARE LANDED COSTS?
Duties, taxes (tariffs) and fees are assessed by your local government as a source of revenue for ecommerce purchases. They are similar to taxes you pay upon purchasing a product in a local store within your own country. We fully guaranteed the duties, taxes and import fees presented at checkout. If you pay duties and taxes at checkout your order will be expedited at customs and you will not be charged any additional fees upon delivery.
WHAT SHIPPING SERVICE LEVELS DO YOU OFFER?
We offer both Express and Standard shipping, and at checkout you can choose which one you prefer.
HOW LONG WILL IT TAKE FOR MY ORDER TO ARRIVE?
The delivery time varies depending on the carrier, the service level and your address. Generally speaking, it takes between 1-5 business days for Express shipments to arrive. And Standard shipments usually take between 6 to 14 business days. Note, these time ranges do not include any delivery delays due to customs clearance.
WHY DO I PAY DUTIES AND TAXES?
All landed costs (duties, taxes and fees) are collected on imports by your country’s customs authorities. The order value, shipping charges, types of commodities and their value, country of manufacture and trade agreements dictate the import duties, taxes and fees levied by your country. Also note, many countries have minimum threshold below which either no duties and/or taxes apply. In addition, countries apply different methods calculating duties and taxes. For example, some countries levy taxes on the shipping fees, while others don’t. In any case, duties and taxes are mandatory and must be paid either at checkout or upon delivery of your order.
HOW DO I PAY DUTIES / TAXES?
Generally speaking, you pay duties and taxes at checkout when you place your order. This way you not only see the total cost upfront before placing the order, but you also won’t have to pay again when the parcel is delivered to you. In a few instances, we may ask you to pay duties and taxes upon delivery.
HOW CAN I TRACK MY ORDER?
We provides you a tracking number and link when your order is being fulfilled which typically happens within 24 – 48 business hours after you place your order (for orders placed over the weekend or during holidays it may take a bit longer). You can track the status of your order through this tracking number and link where updates are posted as your parcel is in transit and delivered to you.
WHAT IF MY ORDER GETS STUCK IN CUSTOMS?
First, we want to let you know that most shipments make it through customs without any delays. That said, from time to time customs authorities review a shipment and may ask for additional information before the customs authorities clear the shipment for final delivery. If we need additional information from you to get your shipment cleared by customs, we will reach out to you. Reviews by customs authorities can take as little as a few hours, but occasionally it can take days or even weeks especially of duties and taxes were not paid upfront.

Johnnie-O Inc. (“Sponsor”) is pleased to introduce the “Johnnie-O March Madness Giveaway” (the “Promotion”). As a condition of participating in the Promotion, you agree to be fully and unconditionally bound by these Official Rules and the decisions of Sponsor, whose decisions shall be final and binding in all respects, and to waive any right to claim ambiguity in the Promotion, these Official Rules, or the Promotion materials. The Promotion is subject to applicable federal, state, and local laws and regulations and is VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Winning and receiving the Prize (as defined in Section 7) is contingent upon fulfilling all requirements set forth herein.

You agree and acknowledge, as condition of participating in the Promotion, that X Corp., formerly Twitter, and its owners, directors, officers, employees, contractors, agents, representatives, parents, subsidiaries, attorneys, insurers, and associated corporations and entities (collectively, the “Social Media Platform”) are not sponsors of the Promotion nor do they endorse or administer the Promotion, nor are they in any way associated with the Promotion. All questions regarding the Promotion must be directed to Sponsor, not the Social Media Platform. 2. PROMOTION PERIOD.
The Promotion begins at 3:00 p.m. Pacific Standard Time (“PT”) on March 16, 2026, and ends at 3:00 p.m. PT on March 17, 2026 (the “Promotion Period”). Pacific Standard Time shall control for all purposed of the Promotion. Sponsor’s computer is the official time keeping device for this Promotion.
3. ELIGIBILITY.
The Promotion is open only to natural persons who: (i) are legal residents of the United States or the District of Columbia that are physically located and residing therein; (ii) are at least eighteen (18) years of age at the time of entry; (iii) are not barred from participation in the Promotion under the laws of the United States, including but not limited to all federal, state, and local laws; and (iv) at all Times abide by these Official Rules.
Officers, directors, members, managers, employees, representatives, and agents of Sponsor and each of its respective parent companies, affiliates, subsidiaries, franchisees, as well as the Prize providers, fulfillment agencies, and any other companies associated with the design or execution of the Promotion (collectively, the “Promotion Entities”), as well as each of their Immediate Family Members (as defined below) and Household Members (as defined below) are not eligible to participate in or win the Promotion. “Immediate Family Members” shall mean spouse, parents, step-parents, legal guardians, children, stepchildren, siblings or step-siblings and each of their spouses regardless of where they reside. “Household Members” shall mean those people who share the same residence at least three (3) months a year.
4. HOW TO ENTER.
NO PURCHASE NECESSARY TO ENTER. During the Promotion Period, eligible persons may enter the Promotion Drawing (as defined in Section 5) as follows:

To “follow” @johnnieO on X, login to your X account and select “Find People” from the tool bar at the top of the homepage. When the search box appears, enter “@johnnieO” and click the “Search” button. Select “Follow” when the @johnnieO icon appears.
- Sponsor will publish one (1) Promotion announcement post regarding the Johnnie-O March Madness Giveaway on X during the Promotion Period. You must like and comment on Sponsor’s Promotion announcement post that is published specifically for this Promotion to be entered. Please note that your comment must comply with (i) these Official Rules and (ii) the X Terms of Service, available at https://x.com/en/tos.
No other method of entry will be accepted other than the method set forth herein. Limit one (1) entry per person for the Promotion. You cannot create multiple X accounts to enter the Promotion. Sponsor reserves the right to void all entries for any person that submits additional entries beyond the specified limit at its sole and absolute discretion. In the event of a dispute over who submitted a winning entry, the Authorized Account Holder for the Social Media Platform account associated with the entry will be deemed to be the entrant. The Authorized Account Holder is defined as the natural person that has established the corresponding account with the Social Media Platform.
Failure to follow any instructions provided by the Sponsor may result in disqualification. The time of receipt of any entry shall be the time such valid entry becomes available to the Sponsor on the corresponding Social Media Platform. The use of script, macro, other automated means or any other device to subvert the entry process is prohibited and all such entries will be void. Sponsor is not responsible for incorrect or inaccurate transcription of entry information, computer, online or human error, technical malfunctions, any omission, interruption, defect, or any other error, including, without limitation, lost, late, incomplete, invalid, unintelligible or misdirected entries, all of which may constitute grounds for disqualification in Sponsor’s sole discretion. If a problem occurs in the entry process, the entrant is solely responsible for verifying that the entry process has been validly completed. The Sponsor shall have no obligation to advise of an incomplete, late or undeliverable entry. All entries become the sole and exclusive property of the Sponsor and will not be acknowledged or returned. Entrant is responsible for all online charges incurred with any Internet service provider and/or wireless carrier.
As a condition of participating in the Promotion, you acknowledge and agree that Sponsor reserves the right to delete your comment and void your entry if it contains any of the following content, as determined by Sponsor at its sole discretion:
- Content that contains personal information, including, without limitation, name, email address, social security information, credit or debit card information, telephone number, etc.;
- Content that may violate or infringe any patent, trademark, trade secret, copyright, right of publicity or other intellectual property, content or proprietary right of any party;
- Content containing advertising, campaign, Promotional materials, spam or other forms of commercial solicitation;
- Content containing spyware, malware, viruses, worms, encrypted messages or any downloadable items;
- Content that is objectionable or which restricts or inhibits any person from enjoying Sponsor’s page on the applicable Social Media Platform, including, without limitation, use of all capital letters or continuous posting of repetitive comments;
- Content that is unlawful, libelous, defamatory, obscene, sexually explicit, harmful to minors, offensive, lewd, vulgar, suggestive, harassing, threatening, tortious, invasive of another’s privacy, abusive, inflammatory, hateful, fraudulent or otherwise objectionable; or
- Content that may expose Sponsor to harm or liability of any type.
5. WINNER SELECTION AND ODDS OF WINNING.
There will be one (1) potential winner selected in the Promotion (“Prize Winner”) via a random drawing on or about March 17, 2026 (the “Random Drawing”), from all eligible entries received during the Promotion Period. The Random Drawing will be conducted by an employee of the Sponsor. Please note the selected Prize Winner is only a potential Prize Winner until eligibility is verified and all aspects of these Official Rules are complied with.
Sponsor will have complete discretion over interpretation of the Official Rules, the administration of the Promotion, and the selection of the potential Prize Winner. All determinations shall be made at the
Sponsor’s reasonable discretion and, as to matters of subjectivity, Sponsor’s sole and absolute discretion.
The odds of winning will depend on the number of eligible entries entered during the Promotion Period.
6. NOTIFICATION AND VERIFICATION OF POTENTIAL PRIZE WINNER.
Sponsor will attempt to notify the potential Prize Winner via direct message on X on the Random Drawing date. Inability of the Sponsor to contact the potential Prize Winner within 24 hours of the Random Drawing may result in the Prize being forfeited and an alternate potential Prize Winner may be selected in another Random Drawing at Sponsor’s discretion.
Sponsor may also deliver via email to the potential Prize Winner an Affidavit of Eligibility and Liability and a Publicity Release (“Release”) to be executed and returned via email (or by facsimile) within 24 hours after receipt of Sponsor’s email. The Release (i) indemnifies and holds harmless Sponsor and any Released Parties (as defined in Section 10) from and against any and all harm, expense, loss, damage, liability, or injury resulting directly or indirectly from submitting an entry in the Promotion or awarding, receipt, possession, use, or misuse of any Prize awarded in the Promotion and (ii) authorizes Sponsor to use the potential Prize Winner’s name, likeness, photograph, voice, and biographical data for advertising, Promotional, and any other purpose, in any media.
If a potential Prize Winner does not meet Official Rules or eligibility requirements, fails to complete, sign and return the applicable Release within the required Time period, or if the Release is returned as undeliverable or incomplete, the potential Prize Winner may be disqualified at Sponsor’s sole discretion. In the event the potential Prize Winner is disqualified for any reason or if the Prize is unclaimed, the Prize will be forfeited. Any forfeited Prize may be awarded to an alternate winner, at Sponsor’s discretion.
THE POTENTIAL PRIZE WINNER IS SUBJECT TO VERIFICATION BY SPONSOR. SPONSOR’S DECISIONS AS TO THE ADMINISTRATION AND OPERATION OF THE PROMOTION, ANY CHANGES TO THESE OFFICIAL RULES, AND THE SELECTION OF A POTENTIAL PRIZE WINNER IS FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.
7. PRIZE.
Subject to verification of eligibility and compliance with these Official Rules, one (1) potential Prize Winner as selected in the Random Drawing will be awarded:
i. Two (2) Tickets to the First Round of March Madness of the winner’s choosing for all sessions (includes all games on the noted day at selected location)
(the “Prize”). The approximate retail value (“ARV”) of the Prize is seven hundred dollars ($700.00) USD. The ARV for a Prize is an estimate made before the Promotion begins and may vary. If the actual retail value of the Prize is less than or greater than the stated ARV, the Prize Winner will not receive the difference.
8. PRIZE RESTRICTIONS.
Limit one (1) Prize Winner for the Promotion. Prize is not transferable. If the Prize Winner is unable to use this Prize within the specified dates, the Prize will be forfeited, and no alternative compensation will be awarded.
Additional Prize award details to be provided to the Prize Winner at the time of notification. In the event winner and/or guest engage in behavior that (as determined by Sponsor or the golf venue) is obnoxious or threatening, illegal, tortious, or intended to threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor or any of Sponsor’s services, products, trademarks, service marks, or logos, Sponsor reserves the right to revoke the Prize, with no further obligations or compensation whatsoever to Prize Winner and/or guest. In the event Prize Winner or guest engages in behavior that (as determined by Sponsor in its sole discretion) is illegal, tortious, or subjects Prize Winner or guest to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments, or other costs or expenses of any kind whatsoever incurred by Prize Winner or guest as a result of such conduct. SPONSOR SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF ANY ASPECT OF PRIZE WINNER’S OR GUEST’S ACTIVITY RELATED TO THIS PROMOTION IN ANY WAY OR THEIR ACCEPTANCE OR USE OF THE PRIZE.
All fees and expenses related to acceptance and use of Prize not specifically stated herein, including but not limited to travel, gratuities and lodging, are the sole responsibility of winner. Prize cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent Prize substitutions at its sole discretion. Only the number of Prizes stated in these Official Rules is available to be won in the Promotion.
The Prize is subject to additional terms and conditions imposed by issuer. No credit or cash will be returned or refunds issued if the full value of the gift card has not been used by its respective expiration date, if any. The Gift Card portion of the Prize will not be replaced if lost or stolen but Sponsor may, in its sole and absolute discretion, replace a lost, stolen or malfunctioning card. In no event will a gift card Prize’s value exceed its stated value.
ALL FEDERAL, STATE, AND LOCAL TAXES AND FEES ARE THE SOLE RESPONSIBILITY OF THE PRIZE WINNER. ALL OTHER COSTS AND EXPENSES RELATED TO ANY PRIZE NOT SPECIFIED HEREIN AND OTHER EXPENSES INCURRED BY ACCEPTING A PRIZE ARE ALSO THE SOLE RESPONSIBILITY OF THE PRIZE WINNER. ANY REQUIRED TAX REPORTING FORMS WILL BE FURNISHED TO THE APPROPRIATE AUTHORITIES. PRIZE WINNERS MAY BE REQUIRED TO PROVIDE THEIR SOCIAL SECURITY NUMBER OR TAX ID FOR TAX REPORTING PURPOSES IF THE COMPANY IS REQUIRED TO FILE AN IRS FORM 1099 WITH THE IRS FOR THE FAIR MARKET VALUE OF A PRIZE AWARDED AND ACCEPTED.
THE PRIZE IS AWARDED AS IS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS MAY NOT ALLOW (OR MAY LIMIT) DISCLAIMERS OF CERTAIN WARRANTIES, IN WHICH CASE THE FOREGOING DISCLAIMERS WILL BE ENFORCED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. RIGHTS OF PUBLICITY AND USE OF PERSONAL INFORMATION.
By entering the Promotion, you acknowledge you will be sharing your personal information with Sponsor. Except where prohibited by law, by entering in this Promotion and/or accepting a Prize, you grant Sponsor and its designees the right to use your name, photograph, likeness, statements, biographical information, testimonials, personal story, voice, address, and other identifying information for any and all commercial purposes of the Sponsor, including, without limitation, advertising and Promotional purposes for this and similar Promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised without additional compensation, review or approval rights, notification or permission.
In addition, by entering, you agree to Sponsor use of your personal information as described in its Privacy Policy. Please refer to Sponsor's Privacy Policy, available at johnnie-O Privacy Policy, for important information regarding their collection, use and disclosure of personal information. Sponsor is not responsible for disclosures made by any third party.
YOU FURTHER ACKNOWLEDGE THAT YOUR PERSONAL IDENTIFYING INFORMATION MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, PLACING YOUR NAME ON A WINNERS’ LIST.
10. GENERAL CONDITIONS AND LIMITATIONS OF LIABILITY.
Any attempt by you to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to prosecute and seek damages from any such person to the fullest extent permitted by law.
Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Neither Sponsor nor anyone acting on its behalf will enter into any communications with any entrant regarding this Promotion, except as expressly set forth in these Official Rules. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be attempting to tamper with or undermine the entry process and/or the legitimate operation of the Promotion; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person.
As a condition of participating in the Promotion, you agree to release, indemnify and hold harmless the Sponsor, the Social Media Platform and the Promotion Entities (the “Released Parties”) from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from any breach of representation made by you in connection with the Promotion, the exercise by the Sponsor or its designees of any of the rights granted by you in these Official Rules and your participation in the Promotion, including acceptance, possession, use, misuse or nonuse of the Prize.
As a condition of participating in the Promotion, you further agree that as to the Sponsor and the Released Parties are not responsible for (i) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) unauthorized human intervention in any part of the entry process or the Promotion; (iv) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from an entrant’s participation in the Promotion or receipt or use or misuse of the Prize.
If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, which corrupt or affect the operation, administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor may, in its sole discretion, void any suspect entries and (i) modify the Promotion or suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; and/or (ii) award the Prize from among the eligible, non-suspect entries received up to the time of the impairment in accordance with the winner selection criteria described above. In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Promotion materials, these Official Rules shall prevail, govern and control.
SPONSOR’S DECISIONS AND INTERPRETATIONS ON ALL MATTERS RELATING TO THE PROMOTION AND THESE OFFICIAL RULES ARE FINAL AND BINDING IN ALL RESPECTS.
11. DISPUTES.
By participating, you agree that any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, or any Prize awarded, shall be resolved individually, without resort to any form of class action. You agree that should you have any such disputes, claims, or causes of action, you shall first allow Sponsor an opportunity to address your concerns. You also further agree that if the dispute or claim is not otherwise resolved through direct discussions with Sponsor, it shall then be resolved by final and binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association ("AAA"). All proceedings brought pursuant to this paragraph will be conducted in North Carolina in the city of Raleigh.
You further agree that: (i) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, and in no event will you be entitled to receive attorneys’ fees or other legal costs; and (ii) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of you and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of North Carolina or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of North Carolina and the forum and venue for any dispute shall be in the city of Raleigh.
12. EXTENDED MEANINGS; CURRENCY; FORCE MAJEURE.
Unless otherwise specified in these Official Rules, words importing the singular include the plural and vice versa and words importing gender include all genders. All dollar amounts referred to in these Official Rules are in lawful money of the United States of America. The Released Parties are not responsible for any damages caused by delay or failure to perform undertakings pursuant to these Official Rules when the delay or failure is due to weather, event cancellations, pandemics, fires, strikes, floods, acts of God or the state’s enemies, lawful acts of public authorities, delays or defaults caused by common carriers, or other events that cannot reasonably be foreseen or provided against.
13. WINNER’S LIST.
For the winner’s name, mail a request and a self-addressed stamped envelope to: Johnnie-O Inc., 4136 Del Rey Avenue, Suite 612, Marina del Rey, CA 90292, Attn: Winner’s List, Johnnie-O March Madness Giveaway. The Winner’s List will be available for three (3) months after the end of the Promotion.
